Guardianship & Conservatorship

 

Guardianship and Conservatorship proceedings may be necessary when an individual is unable to manage their financial or health care affairs and they don’t have planning in place (such as powers of attorney or a trust) that allows someone else to manage their affairs. Guardianship addresses an individual’s personal decisions and Conservatorship addresses an individual’s financial matters. Two common situations requiring Guardianship/Conservatorship are when an aging parent did not prepare a power of attorney and needs the court to appoint a legal fiduciary on their behalf, or when a developmentally delayed child who has reached the age of 18 and the parents no longer have legal decision making authority on their behalf.
